Policy Violation – Shopify Platform Misuse and Circumvention:
As confirmed in my direct communication with Shopify Support, merchants are strictly prohibited from facilitating the sale of counterfeit or infringing goods, including through indirect methods such as “lucky bag” listings, hidden products, or off-platform promotion. Shopify explicitly states that promoting products on social media while completing transactions through concealed or non-transparent listings on their platform constitutes a serious violation of their Acceptable Use Policy and Terms of Service.
The seller in question is engaging in this exact behavior by advertising infringing products on TikTok, directing customers to initiate purchases via WhatsApp, and then completing transactions through a generic “checkout link” on their Shopify store. This setup is intentionally designed to avoid listing the infringing products publicly while still using Shopify’s payment infrastructure to process sales.
This is a clear and deliberate attempt to circumvent Shopify’s enforcement systems while continuing to profit from the sale of infringing goods, in direct violation of Shopify’s stated policies.
I am the owner of US Copyright VA0002449810. This is a formal escalation regarding the persistent, unauthorized use of my registered work by several merchants on your platform.Notice of Repeat Infringement & Policy Circumvention:Despite previous takedowns (see attached list of prior Case IDs), these merchants continue to re-list infringing items. They are intentionally circumventing your enforcement by marketing these products through "lucky games" and "mystery boxes" during Live streams, using Shopify links solely to finalize illegal transactions. These activities violate Shopify’s Acceptable Use Policy regarding:Intellectual Property Infringement: Unauthorized sale of copyrighted works.Deceptive Practices: Using "mystery" formats to hide the sale of counterfeit/infringing goods from automated scanners.Demand for Account Termination:Under 17 U.S.C. § 512 (DMCA), Shopify’s Safe Harbor immunity is contingent upon having and implementing a policy for the termination of repeat infringers. Because Shopify has failed to permanently disable these known repeat offenders, I am formally putting you on notice that Shopify is no longer eligible for Safe Harbor protection regarding these accounts.I request the immediate, permanent closure of the following stores and all associated accounts:[Insert Store URL 1][Insert Store URL 2]I am prepared to escalate this matter to Shopify's banking partners and seek statutory damages of up to $150,000 per infringement as permitted by my registration.Sincerely,
