BELIEVE IT OR NOT , THERE WAS A SECOND D M C A TAKEDOWN OF THE RELISTED LISTING THAT WAS REMOVED BY SHOPIFY FOR A COPYRIGHT INFRINGEMENT.BECAUSE THIS COMPANY IS PLAYING THE LUCKY GAME AND SELLING UNDER THE GUISE OF LUCKY GAME WHILE SELLING MY COPY RIGHTED ITEMS ON ONLINE LIVE.
THIS IS A DIRECT VIOLATION OF SHOPIFY'S POLICIES AND DIRECT DEFIANCE OF THE AUTHORITY OF A D.M C A TAKEDOWN. WITHOUT FURTHER ACTION FROM SHOPIFY SHUTTING THIS STORE DOWN, THEY WILL NO DOUBT CONTINUE TO RELIST.THE PRODUCT THAT IS TAKEN OFF , WHICH IS INFRINGING UPON MY COPYRIGHT. PLEASE REMOVE THIS ENTIRE SHOP IMMEDIATELY AS THEY ARE CONTINUALLY DEFYING SHOPIFY'S POLICIES.

Shopify has already taken action and removed this infringing listing from this seller (hellokikinails.com) under a prior DMCA notice. The seller has now re-listed the same infringing product under a different listing (“Lucky game – Focal beads”) that links from their live sales and includes the sale of my counterfeit products.
This constitutes repeat infringement, evasion and circumvention of Shopify’s policies by attempting to evade enforcement.
The product being sold continues to infringe my copyrighted “Richard” bead design (Daisyland Teething LLC, VAu-449-810), and the seller is demonstrating a pattern of re-uploading infringing content after removal.
I request escalation and review of this seller’s account for repeated violations.

The facebook live account Hellokikinails is displaying and selling unauthorized copies of this design during facebook livestream sales and theu the Lucky game focal listing . Customers are instructed during the livestream to claim items in the chat and then visit the seller’s Shopify store to complete payment through a product titled "Lucky game".
The infringing items are intentionally not listed on the Shopify storefront. Instead, the Shopify store is being used solely as a checkout link for items sold through livestream “claim” sales and mystery or “lucky bag” style transactions.
Shopify support has confirmed that this type of setup violates Shopify’s policies. Shopify does not permit merchants to circumvent platform enforcement by processing payments for infringing or hidden products through alternative listings such as “lucky bags,” “claim sales,” or livestream checkout links while promoting those products externally on social media.

This setup appears to be an attempt to circumvent Shopify’s Acceptable Use Policy and Terms of Service by facilitating the sale of infringing products without listing them directly on the storefront.
There are 3 screenshots of a conversation with a shopify employee Where he explicitly tells me about circumvention and shopify's policy against lucky games.
The two pictures of the individual richards shown are of my copyrighted product.
